Background
T.L.O. (Terry), a 14-year-old freshman named “Terry” at Piscataway High School in New Jersey, was caught smoking in a school bathroom by a teacher. The principal questioned her and asked to see her purse. Inside was a pack of cigarettes, and a illegal drugs. The police were called and “Terry” admitted selling drugs at school.

Her case went to trial and she was found guilty of possession of illegal drugs and placed on probation. Terry appealed (fought) her conviction (being guilty), claiming that the search of her purse violated her Fourth Amendment protection against “unreasonable searches and seizures” of property.

QUESTION

Based upon what you learned about the 4th amendment (search and seizure). Do you believe the school (principal) had the right to search the students property and bag? Explain why your thinking.

  2. No, they broke the law because if the police have a warrant from the judge, they are allow to search your purse but they didn’t. So the police broke the law

  5. Subhy, I dont think the principle was allowed to search Terryś bag. I think this because in the 4th amendment they need a warrant given them by a judge. That is why I dont think the principle should have checked her bag.

  6. I think the principal didn’t break the 4th amendment. I think this because she didn’t want anyone else to use drugs she had or for her to have illegal drugs in school. She looked in her purse because she didn’t want her to use more drugs or have anymore after she took the ones she saw. This is why the principal had the right to look throw Terry’s purse.

I think the principal had the right to search terry’s purse because she was caught trying to hide her smoking and then the principal asked see terry’s purse and she let the principal then he/she found illegal drugs and smokes in it and then terry used her letting the principal see her purse against him/her in the court case. Terry said that it was unreasonable to search her purse because there was no reason but there was, even if terry didnt let the principal search her purse there was still a reason, she was caught smoking.

I believe that if the principal thought that this student had illegal drugs it would be fair that she checked the students purse. I think it wouldn’t be fair if the principal had no reason and just randomly checked this student’s purse.

  13. I do not think that the principal had the right to look through the girls bag even though the girl was breaking the law. The principal did not have a proven case by a judge.But, I do think that the principal was doing the right thing because she was only doing this for the Childs safety.

  14. I think the principal had the right to search Terry because the principal asked to see the girl’s purse she did not force Terry to let her see inside her purse and Terry could have said no.

  15. I think the police were allowed to look through the girls purse because she was caught smoking which meant she was Violating school laws so that leads me to beleive police were allowed to do this.

  17. I believe that the principal had the right to search the student’s bag because she had probable cause. The probable cause was the illegal drugs and the cigarettes in her bag.

For example, it wouldn’t matter if the student was innocent and was abiding by the schools rules without doing things like smoking. In other words, the principal was concerned because the student was doing crazy stuff like selling drugs to others and smoking in school without anyone else knowing.

  20. I think the principal had the right to search Terry’s bags. Terry was caught smoking cigarettes in the bathroom which I believe gives the principal the right to search the bags. Terry is only 14 and it is illegal for her to have cigarettes. This gives the principal reasonable cause to search Terry’s bags.

  23. I do believe that the school (principle) had the right to search the students bags and property. This is because if the school (principle) didn’t search Terry’s bag and property Terry would have kept selling drugs and smoking. I think this because if Terry kept selling drugs and smoking in school she would have got other kids in her school sick. Also the people that she is selling the drugs to and the people she is smoking around would get in trouble too.

I believe that the principal had the right to search Terry’s bag because in the fourth amendment it said that they were not allowed to search a bag if the person had a unreasonable explanation, but the principal had a good reason to check her bag and that reason is that a teacher saw Terry smoking in the school bathroom and told the principal. The principal was right, she found a pack of cigarettes and illegal drugs.

I think yes that the principal had the right to search Terry’s bag.I think this because the principal had reasonable cause to search her bag and because she was caught smoking the principal had suspected that terry had more cigarettes in her bag.And because it was on school property so the principal had the right.And because she’s protecting the school and the students.
